Commissioner of Oaths |
Our Commissioner of Oaths will witness the signatures of people who are affirming/swearing the contents of a document to be true. If you are seeking these services you must visit the Municipal Office in person with photo identification during regular business hours. The Municipality of West Perth does not have a Notary Public on staff. For notary services, please contact a lawyer or public notary.
We strongly recommend booking an appointment time by calling 519-348-8429 x222 to make sure there is a Commissioner of Oaths are available.
Fee
The fee is $10.00, payable by cash or debit.
Documents
Common documents we can witness include:
- consent letters for children travelling out of country
- vehicle transfers
- immunization exemptions
- foreign pension or life pension statements
Examples of documents we cannot witness include:
- wills
- power of attorney documents
- divorce papers or separation agreements
- real estate documents, including transfer of land
We reserve the right to refuse commissioning services of any document.

Freedom of Information |
The Municipal Freedom of Information and Protection of Privacy Act (MFIPPA) provides you with the right to access municipal records with certain limitations and exemptions. The Act requires municipalities to protect personal information and how to collect, retain, use, disclose and dispose of that information. The result is a balance between access to information and protection of personal privacy.
The Municipality of West Perth promotes open government by operating in a manner that fosters and supports the principles of the Municipal Freedom of Information and Protection of Privacy Act.
How do I make a request for Information?
If you wish to access municipal records, please contact the Clerk to see if the records are available for disclosure. You need to make a formal Freedom of Information request if a record is not currently publicly available.

What is the cost?
A mandatory $5.00 application fee must be submitted with the form. Depending on the request, additional fees may apply as per Section 45 of the Act.

- Preparation Time $7.50 - per ¼ hour
- Computer programming $15.00 - per ¼ hour
- Photocopying $0.20 - per page
- CD $10.00
- Any shipping costs

How long will it take?
The Municipality has 30 days after receiving the complete request (including the $5.00 application fee) to respond. The Municipality will provide access to the requested records, or tell you why the records cannot be provided.

How do I know if my organization is eligible? |
In order to qualify for a lottery license, an "eligible" organization must demonstrate that it exists to provide services in one of these charitable classifications:
a) The relief of poverty;
b) The advancement of education;
c) The advancement of religion;
d) Other charitable purposes beneficial to the community, not falling under a), b), or c).
Proceeds from lotteries must be used for charitable or religious objects or purposes in the province of Ontario.
Requirements for eligibility:

Be based within the boundaries of the Municipality of West Perth

Have been in existence for at least one full year prior to being considered eligible

Be in possession of a lottery trust account with two signing offices of the charity with cheque signing privileges and monthly bank statements.

What documents do I need? |
The Municipality must be in possession of the following prior to processing an application:
- Completed Lottery Licence Questionnaire
- Governing Documents: Constitution and /or by-laws, letters patent, charter, trust deed, memorandum of association, signed as required
- Detailed Outline of Programs/Services: What they are, how are they delivered to clients, specific costs, supporting materials, etc.
- Organization's Current Operating Budget
- Organization's Verified Financial Statements for Last Fiscal Year
- List of Board of Directors
- Latest Report to the Public Guardian and Trustee, if Applicable
- Revenue Canada Notification of Registration Letter if Your Organization is Registered
- Membership List, if Applicable
- Organization's Annual Report, if applicable

What are the maximum prizes and fees? |
Bingo:
Prize Maximum: $5,500 (prize value over $5,500 must be provincially licensed)
Fee: 3 percent (3%) of the total prize value.
Raffle or Bazaar:
Prize Maximum: $50,000
Fee: 3 percent (3%) of the total prize value.
Break Open (Nevada):
Prize Maximum: none
Fee: 3 percent (3%) of the total prize value.

Lottery Applications:
Licensees wishing to use proceeds for any purpose not requested on their original application must request a licence amendment and receive approval before using the proceeds for those purposes.

Marriage Licences |
Applying for a Marriage Licence:
Congratulations on your upcoming nuptuals! To get married in Ontario, you must complete a marriage licence application. You must make an appointment with the Clerks Department to receive a marriage licence. Appointments can be made using the "Book Appointment & Submit Application" button below. Appointments are available Monday to Friday from 9:00 a.m. to 4:00 p.m.
Your marriage licence is valid for 90 days from the day it is issued.

Identification Needed |
You will need to bring with you 2 original pieces of government-issued identification for each person getting married. One piece of identification must include a photo.
Examples include:
- Birth certificate
- Valid passport
- Records of immigrant landing
- Canadian citizenship card
- Valid driver's licence
- Valid Ontario Photo Card
Ontario Health Cards and Social Insurance Number (SIN) cards are not acceptable forms of identification.

Marriage Licence Cost |
A marriage licence costs $120.00 and is payable by e-Transfer, cash or debit.
If paying by e-Transfer:
- Through your online banking, create a contact for the Municipality of West Perth using finance@westperth.com as the email address to send the funds to.
- Make sure to put "Marriage Licence" in the description of the payment.
- Password set up not required as this is an auto-deposit. If your bank requires a password set up please confirm your bank is set up for auto-deposit.

Applications by Minors |
You need to be at least 16 years old to get married in Ontario.
If you are under 18 years old you will need written consent from both your parents or legal guardians. You can obtain a consent form at the Municipal Office.

Previously Married? |
Divorced in Canada
Applicants must provide an original or court-certified copy of the Final Decree, Final Judgment, or a Certificate of Divorce. Certified copies can be obtained from the court that granted the divorce. Photocopies will not be accepted.
Out-of-Country Divorces
Applicants who have been divorced outside of Canada must provide documentation to the Province of Ontario prior to being issued an Ontario marriage licence.

I'm Married, now what? |
After the ceremony, the person who performed your wedding provides you with a record of solemnization as a keepsake. This is not a marriage certificate.
You may apply for a marriage certificate from Service Ontario 6 to 8 weeks after your marriage ceremony. Couples can complete a Marriage Certificate Application and mail it directly to the Registrar General's office or request the Marriage Certificate online at Service Ontario.

Fence Viewers |
The Line Fences Act is a procedure to resolve line fence disputes between the owners of adjoining properties. The Act does NOT deal with disputes about fences that are not on the boundary line or disputes about where a boundary line is. Owners of adjoining properties who are unable to reach an agreement about a line fence may apply to the municipality to have the dispute arbitrated by three Fence Viewers who are appointed by Municipal Council.
Fence viewers do not determine the location of a boundary line.
When the Line Fences Act applies:
The Line Fences Act applies when there is a disagreement between two neighbours on:
- which owner is responsible for the line fence work; and
- the type of line fence to be built or repaired
It only applies when:
- no fence exists, and one owner wants a fence constructed to mark the boundary; or
- a line fence already exists, and one owner feels it needs to be reconstructed or repaired.
When the Line Fences Act does not apply:
Fence-Viewers do not deal with disputes:
- over the location of the property boundary,
- where the fence or proposed fence is not on the boundary line,
- where construction or repair of the fence has commenced or is complete,
- where the adjoining property is a municipal or provincial highway.
Application:
Property owners are encouraged to work with their neighbour towards a solution without involving the Fence Viewers.
If a solution can not be found, you will submit a Form 1 – Request for Fence Viewers.

Fees:
There is a $100.00 administration fee for the property owners involved in the dispute. Fence-Viewers determine how the fee is divided between the property owners.
